{"id":7224,"date":"2020-04-28T00:00:00","date_gmt":"2020-04-28T00:00:00","guid":{"rendered":"https:\/\/lynx.legal\/news\/slovensko-neplatenie-najomneho-v-case-korona-krizy\/"},"modified":"2020-04-28T00:00:00","modified_gmt":"2020-04-28T00:00:00","slug":"slovensko-neplatenie-najomneho-v-case-korona-krizy","status":"publish","type":"post","link":"https:\/\/lynx.legal\/sk\/slovensko-neplatenie-najomneho-v-case-korona-krizy\/","title":{"rendered":"Slovensko: Neplatenie n\u00e1jomn\u00e9ho v \u010dase korona kr\u00edzy"},"content":{"rendered":"\n<p><span>V r\u00e1mci bal\u00edku opatren\u00ed na zmiernenie dopadov kr\u00edzy sp\u00f4sobenej COVID\u201319 na ob\u010danov prijal slovensk\u00fd parlament z\u00e1kon, ktor\u00e9ho \u00fa\u010delom je chr\u00e1ni\u0165 n\u00e1jomcu pred ukon\u010den\u00edm n\u00e1jmu zo strany prenaj\u00edmate\u013ea, v&nbsp;pr\u00edpadoch ke\u010f n\u00e1jomca nie je schopn\u00fd uhr\u00e1dza\u0165 n\u00e1jomn\u00e9.&nbsp;&nbsp;<\/span><\/p>\n<p><span>Z\u00e1kon odn\u00edma prenaj\u00edmate\u013eom opr\u00e1vnenie jednostranne ukon\u010dil n\u00e1jomn\u00fd vz\u0165ah s&nbsp;n\u00e1jomcom bytu a\/alebo nebytov\u00e9ho priestoru z&nbsp;d\u00f4vodu, \u017ee je n\u00e1jomca v&nbsp;ome\u0161kan\u00ed s&nbsp;\u00fahradou n\u00e1jomn\u00e9ho a&nbsp;s\u00favisiacich platieb (teda platieb za energie). <\/span><\/p>\n<p><span>Ome\u0161kanie n\u00e1jomcu mus\u00ed vznikn\u00fa\u0165 v&nbsp;obdob\u00ed od 1. apr\u00edla 2020 do 30. j\u00fana 2020. <\/span><\/p>\n<p><span>N\u00e1jomca je povinn\u00fd dostato\u010dne hodnoverne a&nbsp;v\u010das preuk\u00e1za\u0165 prenaj\u00edmate\u013eovi d\u00f4vod svojho ome\u0161kania s&nbsp;platen\u00edm n\u00e1jomn\u00e9ho a&nbsp;s\u00favisiacich platieb. <\/span><\/p>\n<p><span>Z\u00e1konom stanoven\u00fd z\u00e1kaz v\u00fdpovede sa t\u00fdka v\u0161etk\u00fdch druhov n\u00e1jomn\u00fdch vz\u0165ahov, bez oh\u013eadu na to, \u010di boli uzatvoren\u00e9 na zabezpe\u010denie b\u00fdvania fyzick\u00fdch os\u00f4b alebo na podnikate\u013esk\u00e9 \u00fa\u010dely fyzick\u00fdch \u010di pr\u00e1vnick\u00fdch os\u00f4b. <\/span><\/p>\n<p><span>Z\u00e1konom prijat\u00fa zmenu, ale nemo\u017eno pova\u017eova\u0165 za odklad platieb za n\u00e1jomn\u00e9 a&nbsp;s\u00favisiace \u00fahrady n\u00e1jomcom, a&nbsp;teda n\u00e1jomca je tak povinn\u00fd na\u010falej riadne a&nbsp;v\u010das uhr\u00e1dza\u0165 svoje z\u00e1v\u00e4zky vo\u010di prenaj\u00edmate\u013eovi. Neuhradenie n\u00e1jomn\u00e9ho, ale nie je d\u00f4vod na ukon\u010denie n\u00e1jomn\u00e9ho vz\u0165ahu zo strany prenaj\u00edmate\u013ea.
