Z\u00e1rove\u0148 bude mo\u017en\u00e9 v r\u00e1mci 24 mesiacov do\u010dasn\u00e9 pridelenie op\u00e4tovne dohodn\u00fa\u0165 najviac \u0161tyrikr\u00e1t. Obmedzenia sa vz\u0165ahuj\u00fa na do\u010dasn\u00e9 pridelenie toho ist\u00e9ho zamestnanca k tomu ist\u00e9mu zamestn\u00e1vate\u013eovi. To znamen\u00e1, \u017ee zamestnanec sa bude pova\u017eova\u0165 za op\u00e4tovne pridelen\u00e9ho aj vtedy, ak by bol napr\u00edklad n\u00e1sledne pridelen\u00fd inou agent\u00farou do\u010dasn\u00e9ho zamestn\u00e1vania (\u201eADZ\u201c). Ak nebud\u00fa tieto podmienky dodr\u017ean\u00e9, vznikne pracovn\u00fd pomer na dobu neur\u010dit\u00fa priamo medzi pridelen\u00fdm zamestnancom a u\u017e\u00edvate\u013esk\u00fdm zamestn\u00e1vate\u013eom.<\/p>\n<p>Pod\u013ea novej \u00fapravy maj\u00fa by\u0165 ADZ povinn\u00e9 v pracovn\u00fdch zmluv\u00e1ch uzatv\u00e1ran\u00fdch na dobu ur\u010dit\u00fa uv\u00e1dza\u0165 konkr\u00e9tny d\u00e1tum skon\u010denia pracovn\u00e9ho pomeru. Nebude tak u\u017e mo\u017en\u00e9 ur\u010di\u0165 trvanie pracovn\u00e9ho pomeru napr\u00edklad na dobu do\u010dasn\u00e9ho pridelenia, v\u00fdkonu pr\u00e1c, \u010di do skon\u010denia realiz\u00e1cie projektu. V\u00fdnimkou bude len zastupovanie zamestnanca (matersk\u00e1 a rodi\u010dovsk\u00e1 dovolenka, PN at\u010f.) Skon\u010denie do\u010dasn\u00e9ho pridelenia bude z\u00e1rove\u0148 predstavova\u0165 nov\u00fa mo\u017enos\u0165 pre v\u00fdpove\u010f z d\u00f4vodu nadbyto\u010dnosti. V takom pr\u00edpade v\u0161ak treba po\u010d\u00edta\u0165 s pr\u00edslu\u0161nou v\u00fdpovednou dobou ako aj pr\u00edpadn\u00fdm n\u00e1rokom na odstupn\u00e9.<\/p>\n<p>Novelou sa m\u00e1 \u010falej zavies\u0165 tzv. syst\u00e9m spolo\u010dnej zodpovednosti za vyplatenie porovnate\u013enej mzdy pridelen\u00e9mu zamestnancovi. Spolo\u010dn\u00e1 zodpovednos\u0165 bude v praxi vyzera\u0165 tak, \u017ee ak ADZ vyplat\u00ed pridelen\u00e9mu zamestnancovi menej priazniv\u00fa mzdu ne\u017e je mzda porovnate\u013en\u00e9ho (kme\u0148ov\u00e9ho) zamestnanca u\u017e\u00edvate\u013esk\u00e9ho zamestn\u00e1vate\u013ea, tento rozdiel bude musie\u0165 doplati\u0165 u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e. N\u00e1vrh pritom nepo\u010d\u00edta so \u017eiadnymi sankciami pre ADZ, ktor\u00e1 zamestnanca pride\u013euje. Zmluvy medzi ADZ a u\u017e\u00edvate\u013esk\u00fdm zamestn\u00e1vate\u013eom by preto mali prec\u00edzne upravova\u0165 sankcie ako aj mechanizmus kontroly tak, aby mal u\u017e\u00edvate\u013esk\u00fd zamestn\u00e1vate\u013e mo\u017enos\u0165 v\u010das preveri\u0165, \u010di bola mzda vyplaten\u00e1 v po\u017eadovanej v\u00fd\u0161ke.<\/p>\n<p>N\u00e1vrh novely Z\u00e1konn\u00edka pr\u00e1ce moment\u00e1lne post\u00fapil do 2. \u010d\u00edtania a predpoklad\u00e1 sa, \u017ee by mal by\u0165 na programe sch\u00f4dze NR SR e\u0161te v tomto roku.<\/p>\n<p>Zdroj: Vl\u00e1dny n\u00e1vrh z\u00e1kona, ktor\u00fdm sa men\u00ed a dop\u013a\u0148a z\u00e1kon \u010d. 311\/2001 Z.z.
