K\u00fapte ho."},"content":{"rendered":"\n<p>Slovensko: N\u00e1jomcovia nehnute\u013enost\u00ed maj\u00fa \u010dasto z\u00e1ujem zakotvi\u0165 si predkupn\u00e9 pr\u00e1vo k nehnute\u013enosti pre pr\u00edpad, \u017ee prenaj\u00edmate\u013e bude v bud\u00facnosti ma\u0165 z\u00e1ujem o jej predaj.<\/p>\n<p>Umo\u017e\u0148uje v\u0161ak Ob\u010diansky z\u00e1konn\u00edk upravi\u0165 si predkupn\u00e9 pr\u00e1vo s vecnopr\u00e1vnymi \u00fa\u010dinkami aj v inej ako scudzovacej, teda napr. aj priamo v n\u00e1jomnej zmluve? Zmluvn\u00e9 predkupn\u00e9 pr\u00e1vo je v Ob\u010dianskom z\u00e1konn\u00edku zaraden\u00e9 medzi ved\u013eaj\u0161ie dojednania pri k\u00fapnej zmluve. Napriek tomu z\u00e1kon priamo stanovuje, \u017ee ho mo\u017eno dojedna\u0165 nielen v s\u00favislosti s predajom, ale aj pre pr\u00edpad in\u00e9ho scudzenia (najm\u00e4 opri z\u00e1mene \u010di v darovacej zmluve). Z\u00e1kon \u010falej upravuje, \u017ee predkupn\u00e9 pr\u00e1vo mo\u017eno dohodn\u00fa\u0165 aj ako vecn\u00e9 pr\u00e1vo tak, \u017ee bude p\u00f4sobi\u0165 aj vo\u010di n\u00e1stupcom kupuj\u00faceho. Za t\u00fdmto \u00fa\u010delom sa mus\u00ed zmluva uzavrie\u0165 p\u00edsomne a predkupn\u00e9 pr\u00e1vo sa nadob\u00fada vkladom do katastra nehnute\u013enost\u00ed. Ani aktu\u00e1lna slovensk\u00e1 judikat\u00fara v\u0161ak nezaujala jednotn\u00e9 stanovisko k povinnosti zriadenia vecn\u00e9ho predkupn\u00e9ho pr\u00e1va inou ako scudzovacou zmluvou. Najvy\u0161\u0161\u00ed s\u00fad SR v\u0161ak zastal n\u00e1zor, \u017ee predkupn\u00e9 pr\u00e1vo mo\u017eno dohodn\u00fa\u0165 i v \u00faplne samostatnej zmluve, pri\u010dom nie je potrebn\u00e9, aby bolo predmetom scudzovacej zmluvy. Pod\u013ea n\u00e1\u0161ho n\u00e1zoru je v\u00e4\u010d\u0161ina ustanoven\u00ed o zmluvnom predkupnom pr\u00e1ve v Ob\u010dianskom z\u00e1konn\u00edku dispozit\u00edvna.
