Prezident ju v\u0161ak nepodp\u00edsal a vr\u00e1til ju parlamentu na op\u00e4tovn\u00e9 prerokovanie s nieko\u013ek\u00fdmi pripomienkami.<\/p>\n<p>Parlamentom schv\u00e1len\u00e9 znenie novely z\u00e1kona o kolekt\u00edvnom vyjedn\u00e1van\u00ed upravuje podmienky roz\u0161irovania z\u00e1v\u00e4znosti kolekt\u00edvnej zmluvy vy\u0161\u0161ieho stup\u0148a (KZVS) v r\u00e1mci odvetvia alebo jeho \u010dasti na zamestn\u00e1vate\u013eov, ktor\u00ed KZVS neuzatvorili. Odvetvie sa ur\u010duje v s\u00falade so \u0161tatistickou klasifik\u00e1ciou ekonomick\u00fdch \u010dinnost\u00ed SK NACE Rev. 2.<\/p>\n<p>N\u00e1vrh na roz\u0161\u00edrenie z\u00e1v\u00e4znosti KZVS m\u00f4\u017eu poda\u0165 zamestn\u00e1vatelia, pr\u00edpadne zv\u00e4zy zamestn\u00e1vate\u013eov ako aj odborov\u00e9 org\u00e1ny. Na roz\u0161\u00edrenie z\u00e1v\u00e4znosti kolekt\u00edvnej zmluvy nie je potrebn\u00fd s\u00fahlas zamestn\u00e1vate\u013ea. Prakticky bude roz\u0161irovanie prebieha\u0165 tak, \u017ee pr\u00edslu\u0161n\u00e1 odborov\u00e1 organiz\u00e1cia doru\u010d\u00ed Ministerstvu pr\u00e1ce, soci\u00e1lnych vec\u00ed a rodiny n\u00e1vrh na roz\u0161\u00edrenie z\u00e1v\u00e4znosti KZVS na ur\u010dit\u00fdch presne stanoven\u00fdch zamestn\u00e1vate\u013eov. Tento n\u00e1vrh ministerstvo zverejn\u00ed v Obchodnom vestn\u00edku a na svojom webovom s\u00eddle. Zamestn\u00e1vate\u013e m\u00f4\u017ee ministerstvu ozn\u00e1mi\u0165 svoje pripomienky k n\u00e1vrhu na roz\u0161\u00edrenie v lehote 30 dn\u00ed. Pripomienky zamestn\u00e1vate\u013ea posudzuje poradn\u00e1 komisia zriaden\u00e1 ministerstvom na tripartitnom princ\u00edpe. Jej stanovisko m\u00e1 v\u0161ak pre ministerstvo len odpor\u00fa\u010dac\u00ed charakter.<\/p>\n<p>Roz\u0161irovanie z\u00e1v\u00e4znosti KZVS sa net\u00fdka zamestn\u00e1vate\u013ea, na ktor\u00e9ho sa u\u017e vz\u0165ahuje in\u00e1 KZVS, zamestn\u00e1vate\u013ea, ktor\u00fd zamestn\u00e1va menej ako 20 zamestnancov (prezident navrhuje, aby sa po\u010det zv\u00fd\u0161il na 50 zamestnancov) alebo viac ako 10% os\u00f4b so zdravotn\u00fdm postihnut\u00edm. \u010ealej na zamestn\u00e1vate\u013ea, ktor\u00fd vykon\u00e1va podnikate\u013esk\u00fa \u010dinnos\u0165 menej ako 24 mesiacov (neplat\u00ed pre pr\u00e1vneho n\u00e1stupcu), zamestn\u00e1vate\u013ea, ktor\u00e9ho postihla mimoriadna udalos\u0165, zamestn\u00e1vate\u013ea, ktor\u00fd je v \u00fapadku, v likvid\u00e1cii alebo u ktor\u00e9ho bola zaveden\u00e1 n\u00faten\u00e1 spr\u00e1va \u010di ozdravn\u00fd re\u017eim. Prezident \u017eiada, aby sa do novely zapracovala \u010fal\u0161ia v\u00fdnimka, a to \u017ee KZVS sa nebude vz\u0165ahova\u0165 na zamestn\u00e1vate\u013eov, ktor\u00ed u\u017e maj\u00fa uzatvoren\u00fa podnikov\u00fa kolekt\u00edvnu zmluvu.<\/p>\n<p>V d\u00f4vodovej spr\u00e1ve k novele z\u00e1kona sa uv\u00e1dza, \u017ee roz\u0161irovanie KZVS je \u0161tandardn\u00fdm n\u00e1strojom vyu\u017e\u00edvan\u00fdm v r\u00e1mci \u010dlensk\u00fdch \u0161t\u00e1tov E\u00da. Z\u00e1kon m\u00e1 prispie\u0165 k lep\u0161iemu postaveniu zamestnancov, zv\u00fd\u0161eniu ich ochrany v pracovnopr\u00e1vnych vz\u0165ahoch a stabilizova\u0165 pracovn\u00fd trh v danom odvetv\u00ed.
