Pod\u013ea ust\u00e1lenej judikat\u00fary je v&nbsp;tomto pr\u00edpade na platn\u00e9 zriadenie vecn\u00e9ho bremena potrebn\u00e9, aby v\u0161etci spoluvlastn\u00edci boli \u00fa\u010dastn\u00edkmi zmluvy o zriaden\u00ed vecn\u00e9ho bremena, inak je zmluva o zriaden\u00ed vecn\u00e9ho bremena pre rozpor so z\u00e1konom absol\u00fatne neplatn\u00e1.<\/p>\n<p>Koncept podielov\u00e9ho spoluvlastn\u00edctva spo\u010d\u00edva v tom, \u017ee viacer\u00e9 osoby s\u00fa spoluvlastn\u00edkmi spolo\u010dnej veci v ur\u010dit\u00fdch ide\u00e1lnych podieloch. To znamen\u00e1, \u017ee nikto zo spoluvlastn\u00edkov nevlastn\u00ed re\u00e1lne vydelen\u00fa \u010das\u0165 spolo\u010dnej veci zodpovedaj\u00facu v\u00fd\u0161ke jeho spoluvlastn\u00edckeho podielu. Pre pr\u00e1vo zodpovedaj\u00face vecn\u00e9mu bremenu do\u017eivotn\u00e9ho u\u017e\u00edvania nehnute\u013enosti je zase charakteristick\u00e9, \u017ee sa zria\u010fuje bu\u010f na cel\u00fa nehnute\u013enos\u0165 alebo na jej presne vymedzen\u00fa \u010das\u0165 (napr. jedna izba v dome), v d\u00f4sledku \u010doho je opr\u00e1vnen\u00fd z vecn\u00e9ho bremena opr\u00e1vnen\u00fd u\u017e\u00edva\u0165 cel\u00fa nehnute\u013enos\u0165 alebo jej presne vymedzen\u00fa \u010das\u0165. Vzh\u013eadom na to, \u017ee u\u017e\u00edvanie spolo\u010dnej veci sa pova\u017euje za hospod\u00e1renie so spolo\u010dnou vecou, v&nbsp;s\u00falade so z\u00e1konom o&nbsp;u\u017e\u00edvan\u00ed spolo\u010dnej nehnute\u013enosti rozhoduj\u00fa podielov\u00ed spoluvlastn\u00edci jednoduchou v\u00e4\u010d\u0161inou po\u010d\u00edtanou pod\u013ea ve\u013ekosti ich spoluvlastn\u00edckych podielov. Analogicky by teda malo plati\u0165, \u017ee na platn\u00e9 zriadenie pr\u00e1va zodpovedaj\u00faceho vecn\u00e9mu bremenu do\u017eivotn\u00e9ho u\u017e\u00edvania spolo\u010dnej nehnute\u013enosti alebo jej \u010dasti sa nevy\u017eaduje s\u00fahlas v\u0161etk\u00fdch podielov\u00fdch spoluvlastn\u00edkov, ale sta\u010d\u00ed, aby so zriaden\u00edm vecn\u00e9ho bremena s\u00fahlasila v\u00e4\u010d\u0161ina po\u010d\u00edtan\u00e1 pod\u013ea ve\u013ekosti ich spoluvlastn\u00edckych podielov. Pod\u013ea z\u00e1kona v\u0161ak tie\u017e plat\u00ed, \u017ee zmluvou m\u00f4\u017ee zriadi\u0165 vecn\u00e9 bremeno vlastn\u00edk nehnute\u013enosti, pokia\u013e osobitn\u00fd z\u00e1kon ned\u00e1va toto pr\u00e1vo aj \u010fal\u0161\u00edm osob\u00e1m. Z&nbsp;uveden\u00e9ho vypl\u00fdva, \u017ee zriadenie vecn\u00e9ho bremena do\u017eivotn\u00e9ho u\u017e\u00edvania spolo\u010dnej nehnute\u013enosti (\u010di u\u017e celej alebo jej \u010dasti) je vecou dohody v\u0161etk\u00fdch podielov\u00fdch spoluvlastn\u00edkov, teda \u00fa\u010dastn\u00edkmi zmluvy o zriaden\u00ed vecn\u00e9ho bremena v&nbsp;uvedenom pr\u00edpade musia by\u0165 v\u0161etci podielov\u00ed spoluvlastn\u00edci, pri\u010dom s\u00fahlas jednotliv\u00fdch spoluvlastn\u00edkov so zriaden\u00edm tak\u00e9hoto vecn\u00e9ho bremena nie je posta\u010duj\u00faci.
