Stojisk\u00e1 (vyzna\u010den\u00e9 iba horizont\u00e1lnymi zna\u010dkami) dosia\u013e nepodliehali osobitnej pr\u00e1vnej \u00faprave, a preto sa v praxi pred\u00e1vali tak, \u017ee hromadn\u00e1 gar\u00e1\u017e ako nebytov\u00fd priestor bola rozdelen\u00e1 na spoluvlastn\u00edcke podiely, ktor\u00fdch po\u010det zodpovedal spravidla po\u010dtu stoj\u00edsk. Z\u00e1ujemca n\u00e1sledne k\u00fapil to\u013eko spoluvlastn\u00edckych podielov na gar\u00e1\u017ei, o ko\u013eko st\u00e1t\u00ed mal z\u00e1ujem. Nevyhnutn\u00fdm predpokladom fungovania tohto modelu musela by\u0165 dohoda medzi spoluvlastn\u00edkmi o tom, ktor\u00e9 konkr\u00e9tne stojisko prin\u00e1le\u017e\u00ed k spoluvlastn\u00edckemu podielu, preto\u017ee spoluvlastn\u00edcke podiely predstavovali iba n\u00e1rok na ide\u00e1lnu (ne\u0161pecifikovan\u00fa) \u010das\u0165 gar\u00e1\u017ee. Tento stav bol v\u0161ak riskantn\u00fd. Probl\u00e9my nast\u00e1vali v pr\u00edpade n\u00e1sledn\u00fdch prevodov stoj\u00edsk, a to najm\u00e4 vtedy, ak nadob\u00fadate\u013e spoluvlastn\u00edckeho podielu na gar\u00e1\u017ei napr. opomenul prist\u00fapi\u0165 k vy\u0161\u0161ie uvedenej dohode spoluvlastn\u00edkov, alebo opomenul re\u0161pektova\u0165 z\u00e1konn\u00e9 predkupn\u00e9 pr\u00e1va ostatn\u00fdch spoluvlastn\u00edkov (\u010do sa dialo s oh\u013eadom na vysok\u00fd po\u010det podielov prakticky takmer v\u017edy).<\/p>\n<p>Z\u00e1kon od 1. novembra 2018 vyrie\u0161il situ\u00e1ciu tak, \u017ee zaviedol pojem \u201egar\u00e1\u017e v dome\u201c a \u201egar\u00e1\u017eov\u00e9 stojisko\u201c. Gar\u00e1\u017eou v dome je v samostatn\u00fd nebytov\u00fd priestor sl\u00fa\u017eiaci pod\u013ea kolauda\u010dn\u00e9ho rozhodnutia na parkovanie. Gar\u00e1\u017e v dome pozost\u00e1va z presn\u00e9ho po\u010dtu gar\u00e1\u017eov\u00fdch stoj\u00edsk, ktor\u00e9 s\u00edce nie s\u00fa samostatn\u00fdmi nebytov\u00fdmi priestormi, av\u0161ak u\u017e\u00edvacie pr\u00e1vo k nim je po novele zo z\u00e1kona spojen\u00e9 so spoluvlastn\u00edckym podielom na gar\u00e1\u017ei v dome. U\u017e\u00edvacie pr\u00e1vo vypl\u00fdva teda priamo zo z\u00e1kona, a teda nie je viac potrebn\u00e9 uzatv\u00e1ra\u0165 resp. n\u00e1sledne pristupova\u0165 k dohode medzi spoluvlastn\u00edkmi. Nakladanie so stojiskom bude ma\u0165 rovnak\u00fd re\u017eim ako doteraz, a teda prevodom spoluvlastn\u00edckeho podielu a z\u00e1pisom v katastri. Novela navy\u0161e zakotvila, \u017ee u\u017e\u00edvacie pr\u00e1vo k presne \u0161pecifikovan\u00e9mu gar\u00e1\u017eov\u00e9mu stojisku sa zapisuje do katastra nehnute\u013enost\u00ed, \u010d\u00edm je zabezpe\u010den\u00e1 publicita.
