{"id":7175,"date":"2021-06-22T00:00:00","date_gmt":"2021-06-22T00:00:00","guid":{"rendered":"https:\/\/lynx.legal\/news\/romania-acordarea-tichetelor-de-masa-telesalariatilor\/"},"modified":"2021-06-22T00:00:00","modified_gmt":"2021-06-22T00:00:00","slug":"romania-acordarea-tichetelor-de-masa-telesalariatilor","status":"publish","type":"post","link":"https:\/\/lynx.legal\/ro\/romania-acordarea-tichetelor-de-masa-telesalariatilor\/","title":{"rendered":"Romania: Acordarea tichetelor de mas\u0103 telesalaria\u021bilor"},"content":{"rendered":"\n<p><span>\u00cen contextul actual \u00een care munca se desf\u0103\u0219oar\u0103 preponderent \u00een regim de telemunc\u0103, nu de pu\u021bine ori angajatorii s-au confruntat cu problema dac\u0103 telesalaria\u021bii beneficiaz\u0103 sau nu de tichete de mas\u0103 pe durata prest\u0103rii activit\u0103\u021bii \u00een regim de telemunc\u0103.<\/span><\/p>\n<p><span>\u00cen vederea clarific\u0103rii acestui aspect, este necesar\u0103 raportarea la cadrul legislativ principal aplicabil, respectiv la Legea nr. 81\/2018 privind reglementarea activit\u0103\u021bii de telemunc\u0103 (\u201cLegea nr. 81\/2018\u201d) \u0219i Legea 165\/2018 privind acordarea biletelor de valoare (\u201cLegea nr. 165\/2018\u201d). <\/span><\/p>\n<p><span><\/span><\/p>\n<p><span>Pe de o parte, Legea nr. 81\/2018 prevede expres c\u0103 telesalariatul beneficiaz\u0103 de toate drepturile recunoscute prin lege, prin regulamentele interne \u015fi contractele colective de munc\u0103 aplicabile salaria\u021bilor care desf\u0103\u0219oar\u0103 activitatea la locul de munc\u0103 organizat de angajator. <\/span><\/p>\n<p><span><\/span><\/p>\n<p><span>Pe de alt\u0103 parte, urmare a intr\u0103rii \u00een vigoare a Legii nr. 165\/2018, a fost expres abrogat\u0103 Legea nr. 145\/1998 privind acordarea tichetelor de masa care prevedea la art. 6 alin.
