{"id":6869,"date":"2018-11-21T00:00:00","date_gmt":"2018-11-21T00:00:00","guid":{"rendered":"https:\/\/lynx.legal\/news\/nova-judikatura-rakouskeho-nejvyssiho-soudniho-dvora-k-evropskemu-dedickemu-osvedceni\/"},"modified":"2018-11-21T00:00:00","modified_gmt":"2018-11-21T00:00:00","slug":"nova-judikatura-rakouskeho-nejvyssiho-soudniho-dvora-k-evropskemu-dedickemu-osvedceni","status":"publish","type":"post","link":"https:\/\/lynx.legal\/cs\/nova-judikatura-rakouskeho-nejvyssiho-soudniho-dvora-k-evropskemu-dedickemu-osvedceni\/","title":{"rendered":"Nov\u00e1 judikatura rakousk\u00e9ho Nejvy\u0161\u0161\u00edho soudn\u00edho dvora k evropsk\u00e9mu d\u011bdick\u00e9mu osv\u011bd\u010den\u00ed"},"content":{"rendered":"\n<p>Rozsudek rakousk\u00e9ho Nejvy\u0161\u0161\u00edho soudn\u00edho dvora (\u201eOGH\u201c) t\u00fdkaj\u00edc\u00ed se identifikace pozemk\u016f bude m\u00edt dalekos\u00e1hl\u00fd dopad na u\u017e\u00edv\u00e1n\u00ed evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed (EDO) v praxi.<\/p>\n<p>O zku\u0161enostech s evropsk\u00fdm d\u011bdick\u00fdm osv\u011bd\u010den\u00edm (EDO), kter\u00e9 bylo zavedeno Na\u0159\u00edzen\u00edm Evropsk\u00e9ho parlamentu a Rady EU \u010d.650\/2012 a kter\u00e9 m\u016f\u017ee b\u00fdt vystaveno v p\u0159\u00edpad\u011b \u00famrt\u00ed po 17. srpnu 2015, pojedn\u00e1val m\u016fj p\u0159edchoz\u00ed \u010dl\u00e1nek (\u201e<a href=\"\/cs\/zpravy\/pravni-novinky\/2618-entry-of-land-plots-in-a-european-certificate-of-succession-issued-in-germany?layout=bnt:news\">Z\u00e1pis pozemk\u016f do evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed z N\u011bmecka &#8211; Prvn\u00ed praktick\u00e9 zku\u0161enosti s evropsk\u00fdm d\u011bdick\u00fdm osv\u011bd\u010den\u00edm z N\u011bmecka p\u0159in\u00e1\u0161\u00ed v \u010cesk\u00e9 republice roz\u010darov\u00e1n\u00ed.<\/a>\u201c z 20. \u010dervence 2018). Uk\u00e1zalo se, a to i na z\u00e1klad\u011b reakc\u00ed \u010dten\u00e1\u0159\u016f, \u017ee nejen v \u010cesk\u00e9 republice, ale i v Rakousku, na Slovensku a v Ma\u010farsku vznikla \u0159ada probl\u00e9m\u016f, kter\u00e9 se v judikatu\u0159e zat\u00edm nepoda\u0159ilo vy\u0159e\u0161it.<\/p>\n<p>Rozhodnut\u00ed rakousk\u00e9ho Nejvy\u0161\u0161\u00edho soudn\u00edho dvora (OGH, rozsudek z 15. kv\u011btna 2018, \u010d.j.: 5Ob35\/18k) se tak dot\u00fdk\u00e1 z\u00e1sadn\u00ed ot\u00e1zky ve vztahu N\u011bmecka a Rakouska, ale obdobn\u011b i ve vztahu N\u011bmecka a \u010cesk\u00e9 republiky, Ma\u010farska&nbsp;a Slovenska, tj. zda je evropsk\u00e9 d\u011bdick\u00e9 osv\u011bd\u010den\u00ed z N\u011bmecka, kter\u00e9 neobsahuje \u017e\u00e1dnou identifikaci pozemk\u016f, pro p\u0159eps\u00e1n\u00ed rakousk\u00e9ho (pop\u0159. \u010desk\u00e9ho, slovensk\u00e9ho nebo ma\u010farsk\u00e9ho) pozemku dosta\u010duj\u00edc\u00ed.<\/p>\n<h2>&#8222;Z\u00e1sadn\u00ed&#8220; z\u00e1pis do katastru<\/h2>\n<p>T\u00e9m\u011b\u0159 ve v\u0161ech n\u00e1stupnick\u00fdch st\u00e1tech Rakousko \u2013 Uherska je identifikace pozemk\u016f p\u0159i jejich p\u0159evodu a z\u00e1pisu do katastru z\u00e1sadn\u00ed, a to ji\u017e od roku 1750, kdy Marie Terezie v r\u00e1mci sv\u00fdch velk\u00fdch reforem nechala vytvo\u0159it seznam nemovitost\u00ed, zn\u00e1m\u00fd jako \u201eDa\u0148ov\u00fd (Terezi\u00e1nsk\u00fd) katastr\u201c. V EDO vystaven\u00fdch v N\u011bmecku tento z\u00e1pis ale \u010dasto chyb\u00ed, a to p\u0159edev\u0161\u00edm na z\u00e1klad\u011b praxe bavorsk\u00fdch soud\u016f (viz rozsudky Vrchn\u00edho zemsk\u00e9ho soudu v Mnichov\u011b a Vrchn\u00edho zemsk\u00e9ho soudu v Norimberku z roku 2017, kter\u00fdmi se \u0159ada n\u011bmeck\u00fdch obvodn\u00edch soud\u016f \u0159\u00edd\u00ed).<\/p>\n<p>Jeden takov\u00fd p\u0159\u00edpad nyn\u00ed rozhodl OGH ve V\u00eddni: \u010dty\u0159i n\u011bme\u010dt\u00ed d\u011bdicov\u00e9 po\u017eadovali p\u0159eps\u00e1n\u00ed pozemk\u016f nach\u00e1zej\u00edc\u00edch se v Rakousku, a to na z\u00e1klad\u011b n\u011bmeck\u00e9ho EDO, kter\u00e9 ale neobsahovalo jejich identifikaci. Podle m\u00edn\u011bn\u00ed OGH je p\u0159eps\u00e1n\u00ed t\u011bchto pozemk\u016f bez jejich identifikace v EDO mo\u017en\u00e9, jeliko\u017e m\u00e1 evropsk\u00e9 d\u011bdick\u00e9 na\u0159\u00edzen\u00ed p\u0159ednost p\u0159ed katastr\u00e1ln\u00edm pr\u00e1vem jednotliv\u00fdch zem\u00ed.<\/p>\n<p>Tento z\u00e1v\u011br od\u016fvodnil OGH rakouskou zvl\u00e1\u0161tnost\u00ed, toti\u017e \u017ee \u201c&#8230;podle form\u00e1ln\u00edho (rozum\u011bj rakousk\u00e9ho) katastr\u00e1ln\u00edho pr\u00e1va nen\u00ed konkr\u00e9tn\u00ed ozna\u010den\u00ed nemovitosti v evropsk\u00e9m d\u011bdick\u00e9m osv\u011bd\u010den\u00ed (nebo v jeho opise) nezbytn\u00fdm p\u0159edpokladem pro jeho vklad do katastru. Obsah takov\u00e9ho osv\u011bd\u010den\u00ed se \u0159\u00edd\u00ed v\u00fdhradn\u011b \u010dl\u00e1nkem 68 evropsk\u00e9ho na\u0159\u00edzen\u00ed o d\u011bdictv\u00ed, kter\u00fd taxativn\u011b vypo\u010d\u00edt\u00e1v\u00e1 \u00fadaje nezbytn\u00e9 pro vklad a nevy\u017eaduje identifikaci nemovitosti, tak\u017ee absence tohoto \u00fadaje nem\u016f\u017ee br\u00e1nit povolen\u00ed vkladu do katastru na z\u00e1klad\u011b dan\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed. Obsah osv\u011bd\u010den\u00ed p\u0159edlo\u017een\u00e9ho \u017eadatelem proto nevzbuzuje ani z form\u00e1ln\u00edho, ani z materi\u00e1ln\u00edho pohledu \u017e\u00e1dn\u00e9 pochybnosti , proto\u017ee je s n\u00edm spojena (vyvratiteln\u00e1) domn\u011bnka, \u017ee pr\u00e1vn\u00ed postaven\u00ed \u017eadatele uveden\u00e9 v osv\u011bd\u010den\u00ed skute\u010dn\u011b existuje.\u201c Rozhoduj\u00edc\u00ed p\u0159itom bylo, \u017ee EDO jasn\u011b vyjad\u0159ovalo pr\u00e1vn\u00ed postaven\u00ed d\u011bdic\u016f a nikdo jej nezpochybnil.<\/p>\n<h2>Kdo\/co&nbsp;m\u00e1 p\u0159ednost?<\/h2>\n<p>P\u0159edlo\u017een\u00ed Evropsk\u00e9mu soudn\u00edmu dvoru podle \u010dl. 267 Smlouvy o fungov\u00e1n\u00ed EU nebylo podle OGH zjevn\u011b nutn\u00e9, proto\u017ee jeden z p\u0159edpis\u016f rakousk\u00e9ho katastr\u00e1ln\u00edho pr\u00e1va vklad i bez identifikace umo\u017e\u0148uje. V \u010cech\u00e1ch, na Slovensku i v Ma\u010farsku je v\u0161ak toto rozhodnut\u00ed z\u00e1sadn\u00ed, proto\u017ee jasn\u011b stanov\u00ed, \u017ee EDO, pokud bylo vystaveno v souladu se z\u00e1konem, je pro z\u00e1pis dosta\u010duj\u00edc\u00ed, a to i bez identifikace pozemk\u016f; rozhodnut\u00ed OGH v\u0161ak samoz\u0159ejm\u011b nejsou v Ma\u010farsku, na Slovensku a v \u010cesk\u00e9 republice ji\u017e sto let z\u00e1vazn\u00e1. Evropsk\u00fd soudn\u00ed dv\u016fr, jeho\u017e rozhodnut\u00ed pro \u010dlensk\u00e9 st\u00e1ty nesporn\u011b z\u00e1vazn\u00e1 jsou, bohu\u017eel je\u0161t\u011b nevy\u0159e\u0161il ot\u00e1zku, zda m\u00e1 EDO p\u0159ednost p\u0159ed form\u00e1ln\u00edm rejst\u0159\u00edkov\u00fdm nebo katastr\u00e1ln\u00edm pr\u00e1vem jednotliv\u00fdch zem\u00ed. Jen takov\u00e9 rozhodnut\u00ed z\u0159ejm\u011b zabr\u00e1n\u00ed, aby \u010desk\u00e9, slovensk\u00e9 a ma\u010farsk\u00e9 katastr\u00e1ln\u00ed \u00fa\u0159ady nezam\u00edtaly z\u00e1pis vlastnick\u00e9ho pr\u00e1va na z\u00e1klad\u011b n\u011bmeck\u00e9ho EDO s odvol\u00e1n\u00edm na ustanoven\u00ed n\u00e1rodn\u00edho katastr\u00e1ln\u00edho pr\u00e1va.<\/p>\n<p>Jako alternativa se d\u011bdic\u016fm nab\u00edz\u00ed jednak mo\u017enost podat \u017ealobu proti tomuto zam\u00edtav\u00e9mu rozhodnut\u00ed \u010desk\u00e9ho, slovensk\u00e9ho nebo ma\u010farsk\u00e9ho katastr\u00e1ln\u00edho \u00fa\u0159adu, nebo se v N\u011bmecku domoci vystaven\u00ed pou\u017eiteln\u00e9ho osv\u011bd\u010den\u00ed, kter\u00e9 bude pot\u0159ebnou identifikaci pozemk\u016f obsahovat. S v\u00fdjimkou spolkov\u00fdch zem\u00ed Bavorska (Bayern) a Durynska (Th\u00fcringen) je takov\u00fd postup mo\u017en\u00fd, ale \u010dasto zna\u010dn\u011b \u010dasov\u011b n\u00e1ro\u010dn\u00fd a n\u00e1kladn\u00fd.
