{"id":6865,"date":"2020-09-10T00:00:00","date_gmt":"2020-09-10T00:00:00","guid":{"rendered":"https:\/\/lynx.legal\/news\/bitva-za-uznani-evropskeho-dedickeho-osvedceni-uspesne-pokracuje\/"},"modified":"2020-09-10T00:00:00","modified_gmt":"2020-09-10T00:00:00","slug":"bitva-za-uznani-evropskeho-dedickeho-osvedceni-uspesne-pokracuje","status":"publish","type":"post","link":"https:\/\/lynx.legal\/cs\/bitva-za-uznani-evropskeho-dedickeho-osvedceni-uspesne-pokracuje\/","title":{"rendered":"Bitva za uzn\u00e1n\u00ed Evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed \u00fasp\u011b\u0161n\u011b pokra\u010duje."},"content":{"rendered":"\n<p>Evropsk\u00e9 d\u011bdick\u00e9 osv\u011bd\u010den\u00ed v \u010cR znovu na sc\u00e9n\u011b: Z\u00e1pis do katastru nemovitost\u00ed na z\u00e1klad\u011b n\u011bmeck\u00e9ho not\u00e1\u0159sk\u00e9ho z\u00e1pisu a nabyt\u00ed v dobr\u00e9 v\u00ed\u0159e na z\u00e1klad\u011b evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed jsou mo\u017en\u00e9. <\/p>\n<p>T\u00edmto \u010dl\u00e1nkem navazujeme na \u010dl\u00e1nek z ledna 2020, ve kter\u00e9m jsme informovali o \u00fasp\u011b\u0161n\u00e9m uplatn\u011bn\u00ed n\u011bmeck\u00e9ho evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed na z\u00e1klad\u011b evropsk\u00e9ho na\u0159\u00edzen\u00ed o evropsk\u00e9m d\u011bdick\u00e9m osv\u011bd\u010den\u00ed (Na\u0159\u00edzen\u00ed (EU) \u010d. 650\/2012) p\u0159ed \u010desk\u00fdmi soudy proti rozhodnut\u00edm \u010desk\u00fdch katastr\u00e1ln\u00edch \u00fa\u0159ad\u016f (<a href=\"\/cs\/zpravy\/pravni-novinky\/2895-novinky-ve-svete-edo-vitezstvi-v-praze-vyhrane-odvolani-v-olomouci-a-novela-katastralni-vyhlasky-od-1-1-2020?layout=bnt:news\">\u201eNovinky ve sv\u011bt\u011b EDO: v\u00edt\u011bzstv\u00ed v Praze, vyhran\u00e9 odvol\u00e1n\u00ed v Olomouci a novela katastr\u00e1ln\u00ed vyhl\u00e1\u0161ky od 1. 1. 2020\u201c<\/a>). Za\u010d\u00e1tkem dubna vyhov\u011bl Krajsk\u00fd soud v Praze v\u0161em na\u0161im \u017ealob\u00e1m, a\u010dkoliv v p\u0159edlo\u017een\u00e9m evropsk\u00e9m d\u011bdick\u00e9m osv\u011bd\u010den\u00ed (jednalo se st\u00e1le o tot\u00e9\u017e evropsk\u00e9 d\u011bdick\u00e9 osv\u011bd\u010den\u00ed) nebyly specifikov\u00e1ny zd\u011bd\u011bn\u00e9 nemovitosti. P\u0159esn\u011b to v\u0161ak vy\u017eaduje \u010desk\u00fd katastr\u00e1ln\u00ed z\u00e1kon. Od 1.1.2020 lze, vedle evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed, p\u0159edkl\u00e1dat \u010destn\u00e9 prohl\u00e1\u0161en\u00ed d\u011bdic\u016f. Katastr\u00e1ln\u00ed \u00fa\u0159ady po jeho p\u0159edlo\u017een\u00ed a po p\u0159edlo\u017een\u00ed platn\u00e9ho evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed d\u011bdice bez probl\u00e9m\u016f zap\u00ed\u0161\u00ed do katastru. P\u0159esn\u011b stejn\u00fd probl\u00e9m u d\u011bdick\u00fdch osv\u011bd\u010den\u00ed, ve kter\u00fdch nebyl specifikov\u00e1n majetek v p\u0159\u00edloze IV (tuto p\u0159\u00edlohu soudy v Bavorsku a Durynsku nevystavuj\u00ed), existuje i u katastr\u00e1ln\u00edch \u00fa\u0159ad\u016f na Slovensku, v Litv\u011b, v Chorvatsku, v Ma\u010farsku a mo\u017en\u00e1 i jinde. V uveden\u00fdch zem\u00edch se v\u0161ak tento probl\u00e9m, dle na\u0161ich poznatk\u016f, ne\u0159e\u0161\u00ed ani soudn\u011b, ani \u00fapravou z\u00e1kona. Ani Soudn\u00ed dv\u016fr EU se k t\u00e9to ot\u00e1zce dosud nevyj\u00e1d\u0159il.<\/p>\n<p>Nyn\u00ed objasnily dva rozsudky Krajsk\u00e9ho soudu v Praze z 4. kv\u011btna 2020, zda i n\u011bmeck\u00fd not\u00e1\u0159sk\u00fd z\u00e1pis dosta\u010duje pro z\u00e1pis \u010desk\u00fdch pozemk\u016f ve smyslu \u010dl. 59 a n\u00e1sl. evropsk\u00e9ho d\u011bdick\u00e9ho na\u0159\u00edzen\u00ed. Dal\u0161\u00ed rozsudek tohoto soudu ze stejn\u00e9ho dne potvrdil, \u017ee nabyt\u00ed \u010desk\u00e9 nemovitosti v dobr\u00e9 v\u00ed\u0159e na z\u00e1klad\u011b n\u011bmeck\u00e9ho evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed dle \u010dl. 69 odst. 4 evropsk\u00e9ho d\u011bdick\u00e9ho na\u0159\u00edzen\u00ed je mo\u017en\u00e9, i kdy\u017e nemovitost v evropsk\u00e9m d\u011bdick\u00e9m osv\u011bd\u010den\u00ed nen\u00ed v\u016fbec uvedena.<\/p>\n<p>P\u0159edlo\u017een\u00ed n\u011bmeck\u00e9ho not\u00e1\u0159sk\u00e9ho z\u00e1pisu<\/p>\n<p>Krajsk\u00fd soud v Praze nahradil sv\u00fdm rozsudkem zam\u00edtav\u00e1 rozhodnut\u00ed katastr\u00e1ln\u00edho \u00fa\u0159adu o z\u00e1pisu do katastru na z\u00e1klad\u011b not\u00e1\u0159sk\u00e9ho z\u00e1pisu a z\u00e1pis do katastru na\u0159\u00eddil. V mezidob\u00ed katastr\u00e1ln\u00ed \u00fa\u0159ad na\u0159\u00edzen\u00ed soudu vyhov\u011bl. D\u016fvod byl jednoduch\u00fd. Soud posoudil rozd\u011blen\u00ed majetku v n\u011bmeck\u00e9m not\u00e1\u0159sk\u00e9m z\u00e1pisu jako jin\u00fd dokument ve smyslu \u010dl. 59f. evropsk\u00e9ho d\u011bdick\u00e9ho na\u0159\u00edzen\u00ed, a to v kombinaci s platn\u00fdm evropsk\u00fdch d\u011bdick\u00fdm osv\u011bd\u010den\u00edm. Vzhledem k tomu, \u017ee v not\u00e1\u0159sk\u00e9m protokolu byly zaps\u00e1ny pozemky, bylo u\u010din\u011bno zadost i katastr\u00e1ln\u00edmu z\u00e1konu.<\/p>\n<p>Nabyt\u00ed v dobr\u00e9 v\u00ed\u0159e \u010desk\u00e9 nemovitosti na z\u00e1klad\u011b n\u011bmeck\u00e9ho evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed dle \u010dl. 69 odst. 4 evropsk\u00e9ho d\u011bdick\u00e9ho na\u0159\u00edzen\u00ed<\/p>\n<p>Druh\u00e1 \u017ealoba byla pro Krajsk\u00fd soud v Praze ji\u017e slo\u017eit\u011bj\u0161\u00ed, proto\u017ee v tomto p\u0159\u00edpad\u011b p\u0159edlo\u017een\u00e9 n\u011bmeck\u00e9 evropsk\u00e9 d\u011bdick\u00e9 osv\u011bd\u010den\u00ed neobsahovalo specifikaci pozemk\u016f, a proto\u017ee t\u0159et\u00ed osoba, tzn. nabyvatel, se odvol\u00e1val na nabyt\u00ed \u010desk\u00e9 nemovitosti v dobr\u00e9 v\u00ed\u0159e dle \u010dl. 69 odst. 4 evropsk\u00e9ho d\u011bdick\u00e9ho na\u0159\u00edzen\u00ed. Tato \u00faprava odpov\u00edd\u00e1 nabyt\u00ed v dobr\u00e9 v\u00ed\u0159e na z\u00e1klad\u011b dokladu o postaven\u00ed d\u011bdice dle \u00a7 2365 a n\u00e1sl. n\u011bmeck\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku. A\u010dkoliv v evropsk\u00e9m d\u011bdick\u00e9m osv\u011bd\u010den\u00ed nemovitosti nebyly uvedeny, vyhov\u011bl soud na\u0161\u00ed \u017ealob\u011b proti zam\u00edtnut\u00ed z\u00e1pisu katastr\u00e1ln\u00edm \u00fa\u0159adem a na\u0159\u00eddil, \u017ee nabyvatel nemovitost\u00ed od d\u011bdic\u016f, kte\u0159\u00ed nebyli zaps\u00e1ni v \u010desk\u00e9m katastru nemovitost\u00ed, m\u016f\u017ee b\u00fdt p\u0159\u00edmo zaps\u00e1n jako vlastn\u00edk, a\u010dkoliv evropsk\u00e9 d\u011bdick\u00e9 osv\u011bd\u010den\u00ed neobsahovalo \u00fadaj o pozemc\u00edch.<\/p>\n<p>Soudn\u00ed dv\u016fr EU dosud k objasn\u011bn\u00ed nep\u0159isp\u011bl, v praxi v\u0161ak existuje v\u00edce mo\u017enost\u00ed<\/p>\n<p>Soudn\u00ed dv\u016fr EU dosud bohu\u017eel nevyjasnil ot\u00e1zky, t\u00fdkaj\u00edc\u00ed se uv\u00e1d\u011bn\u00ed majetku v evropsk\u00e9m d\u011bdick\u00e9m osv\u011bd\u010den\u00ed, tedy ot\u00e1zku, zda soud na \u017e\u00e1dost mus\u00ed majetek uv\u00e9st, ani ot\u00e1zku, zda katastr\u00e1ln\u00ed \u00fa\u0159ad v zem\u00edch, ve kter\u00fdch katastr\u00e1ln\u00ed z\u00e1kon specifikaci majetku vy\u017eaduje, mus\u00ed p\u0159esto z\u00e1pis prov\u00e9st. Pro praxi v zem\u00edch, ve kter\u00fdch, na rozd\u00edl od \u010cesk\u00e9 republiky, neznaj\u00ed nouzov\u00e9 \u0159e\u0161en\u00ed \u010destn\u00e9ho prohl\u00e1\u0161en\u00ed, se nab\u00edz\u00ed mo\u017enost, jak p\u0159edlo\u017een\u00ed evropsk\u00e9ho d\u011bdick\u00e9ho osv\u011bd\u010den\u00ed katastr\u00e1ln\u00edm \u00fa\u0159ad\u016fm obej\u00edt. U v\u00edce d\u011bdic\u016f m\u016f\u017ee b\u00fdt vyhotoven not\u00e1\u0159sk\u00fd z\u00e1pis, ve kter\u00e9m si d\u011bdicov\u00e9 mezi sebou nemovitost rozd\u011bl\u00ed. To v\u0161ak samoz\u0159ejm\u011b p\u0159edpokl\u00e1d\u00e1 v\u00edce d\u011bdic\u016f a v\u00edce pozemk\u016f. D\u011bdicov\u00e9 d\u00e1le mohou p\u0159ev\u00e9st pozemky na t\u0159et\u00ed osobu, kter\u00e1 bude v dobr\u00e9 v\u00ed\u0159e a kter\u00e1 pak p\u0159\u00edmo pod\u00e1 \u017e\u00e1dost o z\u00e1pis do katastru. V p\u0159\u00edpad\u011b, \u017ee nemovitost zd\u011bd\u00ed jedin\u00fd d\u011bdic a chce si ji ponechat, existuje v sou\u010dasn\u00e9 dob\u011b pouze v \u010cesk\u00e9 republice mo\u017enost dosa\u017een\u00ed z\u00e1pisu do katastru na z\u00e1klad\u011b p\u0159edlo\u017een\u00ed \u010destn\u00e9ho prohl\u00e1\u0161en\u00ed d\u011bdice. V ostatn\u00edch p\u0159\u00edpadech je t\u0159eba z\u00e1pis do katastru vym\u00e1hat p\u0159ed \u010desk\u00fdmi soudy, ale tak\u00e9 p\u0159ed soudy na Slovensku, v Litv\u011b, Chorvatsku nebo Ma\u010farsku, \u017ealobou. Mimo Bavorsko a Durynsko existuje tak\u00e9 mo\u017enost trvat u n\u011bmeck\u00e9ho okresn\u00edho soudu (\u201eAmtsgericht\u201c) na tom, \u017ee nemovitosti maj\u00ed b\u00fdt v evropsk\u00e9m d\u011bdick\u00e9m osv\u011bd\u010den\u00ed zaps\u00e1ny do p\u0159\u00edlohy IV.
