Typick\u00fdm znakem tohoto institutu je podm\u00edn\u011bnost a do\u010dasnost, nebo\u0165 se zpravidla jedn\u00e1 o p\u0159evod pr\u00e1va s rozvazovac\u00ed podm\u00ednkou, \u017ee dluh bude spln\u011bn. <\/p>\n<p>V r\u00e1mci zaji\u0161\u0165ovac\u00edho p\u0159evodu pr\u00e1va funguj\u00ed v z\u00e1sad\u011b dva re\u017eimy. Prvn\u00ed plat\u00ed v p\u0159\u00edpad\u011b, \u017ee se zaji\u0161\u0165ovac\u00ed p\u0159evod pr\u00e1va t\u00fdk\u00e1 v\u011bci zapsan\u00e9 ve ve\u0159ejn\u00e9m seznamu (nap\u0159. nemovitosti zapsan\u00e9 v katastru nemovitost\u00ed). V takov\u00e9m p\u0159\u00edpad\u011b vznik\u00e1 zaji\u0161t\u011bn\u00ed z\u00e1pisem do p\u0159\u00edslu\u0161n\u00e9ho seznamu. V souvislosti s t\u00edm je v\u0161ak d\u016fle\u017eit\u00e9 uv\u00e9st, \u017ee vz\u00e1jemn\u00e1 pr\u00e1va a povinnosti stran vznikaj\u00ed ji\u017e se samotnou \u00fa\u010dinnost\u00ed smlouvy o zaji\u0161\u0165ovac\u00edm p\u0159evodu pr\u00e1va. <\/p>\n<p>Ve druh\u00e9m p\u0159\u00edpad\u011b, tj. tehdy, kdy\u017e p\u0159edm\u011btem zaji\u0161\u0165ovac\u00edho p\u0159evodu pr\u00e1va je v\u011bc, kter\u00e1 se nezapisuje do ve\u0159ejn\u00e9ho seznamu, je zaji\u0161\u0165ovac\u00ed p\u0159evod \u00fa\u010dinn\u00fd ji\u017e okam\u017eikem uzav\u0159en\u00ed smlouvy. <\/p>\n<p>A\u010d nen\u00ed zcela jasn\u00e9, zda jde o \u00famysl \u010di omyl z\u00e1konod\u00e1rce, jednou z d\u016fle\u017eit\u00fdch novinek dle NOZ je mo\u017enost sjednat zaji\u0161\u0165ovac\u00ed p\u0159evod pr\u00e1va jako tzv. fiduci\u00e1rn\u00ed p\u0159evod. Strany se mohou nov\u011b dohodnout, \u017ee spln\u011bn\u00edm zaji\u0161t\u011bn\u00e9ho dluhu nedojde k obnoven\u00ed pr\u00e1v k objektu p\u0159evodu u p\u016fvodn\u00edho vlastn\u00edka automaticky, ale je t\u0159eba, aby zaji\u0161t\u011bn\u00fd v\u011b\u0159itel p\u0159evedl sv\u00fdm &#8211; nov\u00fdm &#8211; pr\u00e1vn\u00edm jedn\u00e1n\u00edm p\u0159edm\u011bt zaji\u0161t\u011bn\u00ed zp\u011bt na jeho p\u016fvodn\u00edho vlastn\u00edka. Fiduci\u00e1rn\u00ed p\u0159evod mus\u00ed b\u00fdt mezi stranami v\u017edy v\u00fdslovn\u011b sjedn\u00e1n. Nestane-li se tak, pak se v\u017edy uplatn\u00ed vyvratiteln\u00e1 domn\u011bnka s konstrukc\u00ed p\u0159evodu pr\u00e1va s rozvazovac\u00ed podm\u00ednkou. <\/p>\n<p>K zaji\u0161\u0165ovac\u00edmu p\u0159evodu pr\u00e1va ji\u017e nen\u00ed vy\u017eadov\u00e1na p\u00edsemn\u00e1 forma pr\u00e1vn\u00edho jedn\u00e1n\u00ed.
