{"id":6823,"date":"2015-08-05T00:00:00","date_gmt":"2015-08-05T00:00:00","guid":{"rendered":"https:\/\/lynx.legal\/news\/vyhrada-vlastnictvi-stroje\/"},"modified":"2015-08-05T00:00:00","modified_gmt":"2015-08-05T00:00:00","slug":"vyhrada-vlastnictvi-stroje","status":"publish","type":"post","link":"https:\/\/lynx.legal\/cs\/vyhrada-vlastnictvi-stroje\/","title":{"rendered":"V\u00fdhrada vlastnictv\u00ed stroje"},"content":{"rendered":"\n<p>Czech Republic: V\u00fdhrada vlastnictv\u00ed stroje zapsan\u00e1 v katastru nemovitost\u00ed prolamuje superfici\u00e1ln\u00ed z\u00e1sadu<\/p>\n<p>Nov\u00fd ob\u010dansk\u00fd z\u00e1kon\u00edk vr\u00e1til do \u010desk\u00e9ho pr\u00e1vn\u00edho \u0159\u00e1du tzv. superfici\u00e1ln\u00ed z\u00e1sadu, tedy \u017ee stavby a v\u0161e, co je zapu\u0161t\u011bno v pozemku nebo upevn\u011bno ve zdech, je sou\u010d\u00e1st\u00ed pozemku. <\/p>\n<p>V d\u016fsledku t\u00e9to z\u00e1sady se tak sou\u010d\u00e1st\u00ed pozemku st\u00e1vaj\u00ed nejenom ve\u0161ker\u00e9 stavby, ale tak\u00e9 stroje, resp. jin\u00e1 za\u0159\u00edzen\u00ed upevn\u011bn\u00e1 ve zdech t\u011bchto staveb (pro oboj\u00ed je d\u00e1le pou\u017eito ozna\u010den\u00ed stroj). To v\u0161ak pouze za p\u0159edpokladu, pokud je stroj spojen s nemovitost\u00ed takov\u00fdm zp\u016fsobem, kter\u00fd napln\u00ed krit\u00e9ria pro to, aby takov\u00fd stroj mohl b\u00fdt pova\u017eov\u00e1n za sou\u010d\u00e1st nemovit\u00e9 v\u011bci. Ob\u010dansk\u00fd z\u00e1kon\u00edk k tomu stanov\u00ed, \u017ee sou\u010d\u00e1st\u00ed v\u011bci (v tomto p\u0159\u00edpad\u011b nemovitosti) je v\u0161e, co k n\u00ed podle jej\u00ed povahy n\u00e1le\u017e\u00ed a co nem\u016f\u017ee b\u00fdt od v\u011bci odd\u011bleno, ani\u017e se t\u00edm v\u011bc znehodnot\u00ed. <\/p>\n<p>Ov\u0161em za ur\u010dit\u00fdch okolnost\u00ed je mo\u017en\u00e9, aby se stroj nestal sou\u010d\u00e1st\u00ed nemovitosti. A to v p\u0159\u00edpad\u011b, pokud je nemovitost zaps\u00e1na v katastru nemovitost\u00ed a se souhlasem jej\u00edho vlastn\u00edka tam bude zaps\u00e1na v\u00fdhrada, \u017ee nen\u00ed sou\u010dasn\u011b vlastn\u00edkem p\u0159edm\u011btn\u00e9ho stroje. V takov\u00e9m p\u0159\u00edpad\u011b je i stroj, kter\u00fd by jinak byl sou\u010d\u00e1st\u00ed nemovitosti, pova\u017eov\u00e1n za samostatnou v\u011bc v pr\u00e1vn\u00edm smyslu. Proveden\u00edm z\u00e1pisu v\u00fdhrady vlastnictv\u00ed stroje se tak prolamuje superfici\u00e1ln\u00ed z\u00e1sada a nast\u00e1v\u00e1 stav odd\u011blen\u00e9ho vlastnictv\u00ed nemovit\u00e9 v\u011bci a stroje. <\/p>\n<p>To je v\u00fdhodn\u00e9 zejm\u00e9na v situac\u00edch, kdy ur\u010dit\u00e1 osoba u\u017e\u00edv\u00e1 nemovitost na z\u00e1klad\u011b n\u00e1jmu \u010di pachtu a hodl\u00e1 v dan\u00e9 nemovitosti um\u00edstit (zapustit) stroj takov\u00fdm zp\u016fsobem, \u017ee by se za norm\u00e1ln\u00edch okolnost\u00ed stal sou\u010d\u00e1st\u00ed nemovitosti. V\u00fdhradou vlastnictv\u00ed zapsanou v katastru nemovitost\u00ed se tak chr\u00e1n\u00ed vlastnick\u00e9 pr\u00e1vo u\u017eivatele nemovitosti (vlastn\u00edka stroje), nap\u0159. p\u0159i exekuci na majetek vlastn\u00edka nemovitosti.
