{"id":6814,"date":"2015-05-18T00:00:00","date_gmt":"2015-05-18T00:00:00","guid":{"rendered":"https:\/\/lynx.legal\/news\/nezbytna-cesta\/"},"modified":"2015-05-18T00:00:00","modified_gmt":"2015-05-18T00:00:00","slug":"nezbytna-cesta","status":"publish","type":"post","link":"https:\/\/lynx.legal\/cs\/nezbytna-cesta\/","title":{"rendered":"Nezbytn\u00e1 cesta"},"content":{"rendered":"\n<p>Czech Republic: Zp\u016fsob z\u0159\u00edzen\u00ed nezbytn\u00e9 cesty podle nov\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku<\/p>\n<p>Nov\u00fd ob\u010dansk\u00fd z\u00e1kon\u00edk zavedl do \u010desk\u00e9ho pr\u00e1vn\u00edho prost\u0159ed\u00ed staronov\u00fd institut nezbytn\u00e9 cesty, respektive stanov\u00ed pravidla, jak povolen\u00ed nezbytn\u00e9 cesty p\u0159es ciz\u00ed pozemek z\u0159\u00eddit. <\/p>\n<p>O povolen\u00ed nezbytn\u00e9 cesty p\u0159es sousedn\u00ed pozemek m\u016f\u017ee \u017e\u00e1dat vlastn\u00edk nemovit\u00e9 v\u011bci, na n\u00ed\u017e nelze \u0159\u00e1dn\u011b hospoda\u0159it nebo ji \u0159\u00e1dn\u011b u\u017e\u00edvat proto, \u017ee nen\u00ed dostate\u010dn\u011b spojena s ve\u0159ejnou cestou. D\u016fvodem pro povolen\u00ed nezbytn\u00e9 cesty nem\u016f\u017ee b\u00fdt jen po\u017eadavek pohodln\u011bj\u0161\u00edho spojen\u00ed, ale faktick\u00e1 neexistence dostate\u010dn\u00e9ho p\u0159\u00edstupu. Za povolen\u00ed nezbytn\u00e9 cesty n\u00e1le\u017e\u00ed vlastn\u00edkovi pozemku \u00faplata a p\u0159\u00edpadn\u011b tak\u00e9 od\u010din\u011bn\u00ed \u00fajmy, pokud ji\u017e nen\u00ed zapo\u010dteno v \u00faplat\u011b. <\/p>\n<p>Nezbytnou cestu povoluje soud, kter\u00fd tak\u00e9 vymez\u00ed jej\u00ed rozsah, jen\u017e odpov\u00edd\u00e1 pot\u0159eb\u011b vlastn\u00edka nemovit\u00e9 v\u011bci \u0159\u00e1dn\u011b ji u\u017e\u00edvat s n\u00e1klady co nejmen\u0161\u00edmi. Nezbytnou cestu je mo\u017eno zalo\u017eit bu\u010f jako soukromou obligaci (povinnost) \u010di jako slu\u017eebnost, tedy v\u011bcn\u00e9 pr\u00e1vo postihuj\u00edc\u00ed vlastn\u00edka t\u00edm, \u017ee mus\u00ed ve prosp\u011bch vlastn\u00edka jin\u00e9 nemovitosti n\u011bco trp\u011bt nebo n\u011b\u010deho se zdr\u017eet. <\/p>\n<p>Z\u0159\u00edzen\u00edm \u010di u\u017e\u00edv\u00e1n\u00edm nezbytn\u00e9 cesty mus\u00ed b\u00fdt vlastn\u00edk pozemku co nejm\u00e9n\u011b obt\u011b\u017eov\u00e1n a pozemek co nejm\u00e9n\u011b zasa\u017een. Pokud byla nezbytn\u00e1 cesta z\u0159\u00edzena jako um\u011bl\u00e1, je povinen ji udr\u017eovat ten, v jeho\u017e prosp\u011bch byla povolena. <\/p>\n<p>Obklopuje-li nemovitou v\u011bc bez p\u0159\u00edstupu n\u011bkolik sousedn\u00edch pozemk\u016f, povol\u00ed se nezbytn\u00e1 cesta jen p\u0159es jeden z nich. P\u0159itom se uv\u00e1\u017e\u00ed, p\u0159es kter\u00fd pozemek je nejp\u0159irozen\u011bj\u0161\u00ed p\u0159\u00edstup a kde bude vlastn\u00edk nejm\u00e9n\u011b obt\u011b\u017eov\u00e1n. <\/p>\n<p>Soud nezbytnou cestu nepovol\u00ed, pokud \u0161koda na povinn\u00e9 nemovit\u00e9 v\u011bci zjevn\u011b p\u0159ev\u00fd\u0161\u00ed v\u00fdhodu nezbytn\u00e9 cesty, nebo pokud si ten, kdo o ni \u017e\u00e1d\u00e1, zp\u016fsobil nedostatek p\u0159\u00edstupu k ve\u0159ejn\u00e9 cest\u011b z hrub\u00e9 nedbalosti nebo dokonce \u00famysln\u011b.
