Zat\u00edmco z\u00e1kaz zat\u00ed\u017een\u00ed p\u0159edstavuje omezen\u00ed z\u0159\u00edzen\u00ed z\u00e1stavn\u00edho pr\u00e1va, z\u00e1kazem zcizen\u00ed se rozum\u00ed z\u00e1kaz prodeje v\u011bci, nebo v p\u0159\u00edsn\u011bj\u0161\u00edm pr\u00e1vn\u00edm v\u00fdkladu i z\u00e1kaz dal\u0161\u00edch dispozic\u00ed s v\u011bc\u00ed (nap\u0159. v p\u0159\u00edpad\u011b nemovitost\u00ed n\u00e1jem nebo pron\u00e1jem).<\/p>\n<p>Z\u00e1kaz zat\u00ed\u017een\u00ed nebo zcizen\u00ed je mo\u017en\u00e9 z\u0159\u00eddit jen na dobu ur\u010ditou, a to pouze na dobu p\u0159im\u011b\u0159enou. Z\u0159\u00edzen\u00ed z\u00e1kazu zat\u00ed\u017een\u00ed nebo zcizen\u00ed z\u00e1rove\u0148 mus\u00ed b\u00fdt od\u016fvodn\u011bno ur\u010dit\u00fdm z\u00e1jmem, kter\u00fd je hodn\u00fd pr\u00e1vn\u00ed ochrany.<\/p>\n<p>Z\u00e1kaz zat\u00ed\u017een\u00ed nebo zcizen\u00ed v\u011bci p\u016fsob\u00ed v z\u00e1sad\u011b jen mezi smluvn\u00edmi stranami. Bude-li v\u0161ak zaps\u00e1n do ve\u0159ejn\u00e9ho seznamu (nap\u0159. v p\u0159\u00edpad\u011b nemovitost\u00ed do katastru nemovitost\u00ed, v p\u0159\u00edpad\u011b pod\u00edl\u016f nebo akci\u00ed do obchodn\u00edho rejst\u0159\u00edku), bude \u00fa\u010dinn\u00fd i v\u016f\u010di t\u0159et\u00edm osob\u00e1m. T\u0159et\u00ed osoba tedy nem\u016f\u017ee v\u011bc sti\u017eenou takov\u00fdm z\u00e1kazem platn\u011b nab\u00fdt nebo k n\u00ed z\u00edskat z\u00e1stavn\u00ed pr\u00e1vo.<\/p>\n<p>Tento institut reflektuje nov\u00e9 modern\u00ed trendy bankovn\u00edho financov\u00e1n\u00ed a z hlediska v\u011b\u0159itel\u016f nepochybn\u011b p\u0159edstavuje praktickou mo\u017enost dal\u0161\u00edho zaji\u0161t\u011bn\u00ed.
