Toto na\u0159\u00edzen\u00ed vl\u00e1da vydala k proveden\u00ed ob\u010dansk\u00e9ho z\u00e1kon\u00edku (\u00a7 2257 odst. 2), kter\u00fd ur\u010duje, \u017ee n\u00e1jemce bytu hrad\u00ed a prov\u00e1d\u00ed pouze b\u011b\u017enou \u00fadr\u017ebu a drobn\u00e9 opravy souvisej\u00edc\u00ed s u\u017e\u00edv\u00e1n\u00edm bytu. Jedn\u00e1 se p\u0159itom o ustanoven\u00ed relativn\u011b (jednostrann\u011b) kogentn\u00ed, tj. nelze se od n\u011bj smluvn\u011b odch\u00fdlit v neprosp\u011bch n\u00e1jemce bytu (viz ust. \u00a7 2235 odst. 1 ob\u010dansk\u00e9ho z\u00e1kon\u00edku).<\/p>\n<p>C\u00edlem na\u0159\u00edzen\u00ed je pos\u00edlit pr\u00e1vn\u00ed jistotu n\u00e1jemce a pronaj\u00edmatele ohledn\u011b prov\u00e1d\u011bn\u00ed a \u00fahrady \u00fadr\u017eby a oprav pronajat\u00e9ho bytu. Od \u00fa\u010dinnosti sou\u010dasn\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku toti\u017e pojmy b\u011b\u017en\u00e1 \u00fadr\u017eba a drobn\u00e9 opravy souvisej\u00edc\u00ed s u\u017e\u00edv\u00e1n\u00edm bytu nebyly nikde definov\u00e1ny a z\u00e1le\u017eelo tak na jejich v\u00fdkladu smluvn\u00edmi stranami, resp. soudem v p\u0159\u00edpad\u011b sporu smluvn\u00edch stran o jejich v\u00fdklad. Toto na\u0159\u00edzen\u00ed p\u0159itom navazuje na ob\u010dansk\u00fdm z\u00e1kon\u00edkem zru\u0161en\u00e9 na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 258\/1995 Sb., kter\u00fdm se prov\u00e1d\u011bl star\u00fd ob\u010dansk\u00fd z\u00e1kon\u00edk z roku 1964. Odli\u0161nost spo\u010d\u00edv\u00e1 zejm\u00e9na ve zv\u00fd\u0161en\u00ed horn\u00edho limitu n\u00e1klad\u016f na jednu drobnou opravu (n\u00e1klad nesm\u00ed p\u0159evy\u0161ovat 1.000,- K\u010d) a zv\u00fd\u0161en\u00ed horn\u00edho limitu ro\u010dn\u00edho sou\u010dtu n\u00e1klad\u016f za drobn\u00e9 opravy (100, K\u010d\/m2 podlahov\u00e9 plochy bytu), kter\u00e9 je povinen prov\u00e1d\u011bt a hradit n\u00e1jemce.
