Dle na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 590\/2006 Sb. je zam\u011bstnavatel povinen poskytnout zam\u011bstnanci pracovn\u00ed volno s n\u00e1hradou mzdy p\u0159i vy\u0161et\u0159en\u00ed nebo o\u0161et\u0159en\u00ed ve zdravotnick\u00e9m za\u0159\u00edzen\u00ed na dobu nezbytn\u011b nutnou, pokud je toto vy\u0161et\u0159en\u00ed provedeno ve zdravotnick\u00e9m za\u0159\u00edzen\u00ed, kter\u00e9 je (s ohledem na zdravotn\u00ed poji\u0161\u0165ovnu zam\u011bstnance) nejbl\u00ed\u017ee bydli\u0161ti nebo pracovi\u0161ti zam\u011bstnance a je schopn\u00e9 pot\u0159ebnou zdravotn\u00ed p\u00e9\u010di poskytnout, pokud vy\u0161et\u0159en\u00ed nebo o\u0161et\u0159en\u00ed nebylo mo\u017en\u00e9 prov\u00e9st mimo pracovn\u00ed dobu.<\/p>\n<p>Zam\u011bstnanec m\u016f\u017ee po\u017eadovat tak\u00e9 volno k n\u00e1v\u0161t\u011bv\u011b jin\u00e9ho ne\u017e nejbli\u017e\u0161\u00edho zdravotnick\u00e9ho za\u0159\u00edzen\u00ed. V tomto p\u0159\u00edpad\u011b mu v\u0161ak n\u00e1le\u017e\u00ed n\u00e1hrada mzdy pouze za dobu, kterou by str\u00e1vil v nejbli\u017e\u0161\u00edm zdravotnick\u00e9m za\u0159\u00edzen\u00ed. Pracovn\u00ed volno se op\u011bt poskytne pouze na nezbytn\u011b nutnou dobu.<\/p>\n<p>Z v\u00fd\u0161e uveden\u00e9ho plyne, \u017ee zam\u011bstnanec, kter\u00fd m\u00e1 nap\u0159\u00edklad nerovnom\u011brn\u011b rozvr\u017eenou pracovn\u00ed dobu nebo sm\u011bnn\u00fd provoz, by si m\u011bl n\u00e1v\u0161t\u011bvu l\u00e9ka\u0159e obstarat mimo svou pracovn\u00ed dobu, je-li to mo\u017en\u00e9. Nen\u00ed-li to mo\u017en\u00e9 a n\u00e1v\u0161t\u011bva l\u00e9ka\u0159e mus\u00ed prob\u011bhnout v pracovn\u00ed dobu, m\u00e1 zam\u011bstnanec n\u00e1rok na proplacen\u00ed doby \u201enezbytn\u011b nutn\u00e9\u201c, kterou by str\u00e1vil v nejbli\u017e\u0161\u00edm zdravotn\u00edm za\u0159\u00edzen\u00ed.
