Jedn\u00edm z projev\u016f t\u00e9to z\u00e1sady je i ochrana rodinn\u00e9 dom\u00e1cnosti, kterou se rozum\u00ed jednak pospolitost spolu \u017eij\u00edc\u00edch osob, zpravidla man\u017eel\u016f a p\u0159\u00edpadn\u011b jejich nezletil\u00fdch d\u011bt\u00ed, ale tak\u00e9 i za\u0159\u00edzen\u00e9 obydl\u00ed, ve kter\u00e9m tyto spolu \u017eij\u00edc\u00ed osoby tvo\u0159\u00edc\u00ed rodinnou dom\u00e1cnost trvale bydl\u00ed.<\/p>\n<p>Ochrana rodinn\u00e9 dom\u00e1cnosti se projevuje mimo jin\u00e9 t\u00edm, \u017ee man\u017eel, kter\u00fd je jinak opr\u00e1vn\u011bn s domem \u010di bytem, v n\u011bm\u017e se nach\u00e1z\u00ed rodinn\u00e1 dom\u00e1cnost, samostatn\u011b nakl\u00e1dat (pokud je nap\u0159\u00edklad jeden z man\u017eel\u016f v\u00fdlu\u010dn\u00fdm vlastn\u00edkem nemovitosti, v n\u00ed\u017e se rodinn\u00e1 dom\u00e1cnost nach\u00e1z\u00ed), se mus\u00ed zdr\u017eet v\u0161eho, co m\u016f\u017ee bydlen\u00ed rodinn\u00e9 dom\u00e1cnosti v takov\u00e9m byt\u011b \u010di dom\u011b znemo\u017enit nebo ohrozit. Takov\u00fd man\u017eel zejm\u00e9na nesm\u00ed bez souhlasu druh\u00e9ho man\u017eela d\u016fm nebo byt zcizit nebo k domu, jeho \u010d\u00e1sti nebo k cel\u00e9mu bytu, z\u0159\u00eddit pr\u00e1vo, jeho\u017e v\u00fdkon je neslu\u010diteln\u00fd s bydlen\u00edm man\u017eel\u016f nebo rodiny, leda\u017ee zajist\u00ed man\u017eelovi nebo rodin\u011b po v\u0161ech str\u00e1nk\u00e1ch obdobn\u00e9 bydlen\u00ed s bydlen\u00edm dosavadn\u00edm. Obdobn\u00e9 pravidlo plat\u00ed i pro mo\u017enost ukon\u010den\u00ed n\u00e1jemn\u00edho pr\u00e1va k domu \u010di bytu, ve kter\u00e9m se nach\u00e1z\u00ed rodinn\u00e1 dom\u00e1cnost.<\/p>\n<p>V p\u0159\u00edpad\u011b poru\u0161en\u00ed v\u00fd\u0161e uveden\u00e9ho z\u00e1kazu se m\u016f\u017ee druh\u00fd z man\u017eel\u016f dovolat neplatnosti takov\u00e9ho pr\u00e1vn\u00edho jedn\u00e1n\u00ed, kter\u00fdm do\u0161lo k ohro\u017een\u00ed rodinn\u00e9 dom\u00e1cnosti, a to a\u017e ve lh\u016ft\u011b 3 let ode dne, kdy se man\u017eel o takov\u00e9m ohro\u017euj\u00edc\u00edm pr\u00e1vn\u00edm jedn\u00e1n\u00edm dozv\u011bd\u011bl, \u010di dov\u011bd\u011bt m\u011bl a mohl.<\/p>\n<p>Nejvy\u0161\u0161\u00ed soud pak v ned\u00e1vno zve\u0159ejn\u011bn\u00e9m rozhodnut\u00ed potvrdil, \u017ee v\u00fd\u0161e uveden\u00e1 ochrana rodinn\u00e9 dom\u00e1cnosti m\u00e1 p\u0159ednost i p\u0159ed ochrannou dobr\u00e9 v\u00edry t\u0159et\u00ed osoby, kter\u00e1 jedn\u00e1 pouze s jedn\u00edm z man\u017eel\u016f, kter\u00fd je v katastru nemovitost\u00ed zaps\u00e1n jako v\u00fdlu\u010dn\u00fd vlastn\u00edk p\u0159edm\u011btn\u00e9 nemovitosti. Ochrana rodinn\u00e9 dom\u00e1cnosti toti\u017e nen\u00ed nijak zalo\u017eena na vlastnick\u00e9m \u010di jin\u00e9m pr\u00e1vu k nemovitosti zapisovan\u00e9m do katastru nemovitost\u00ed, stejn\u011b tak se do katastru nemovitost\u00ed nezapisuje ani samotn\u00e1 rodinn\u00e1 dom\u00e1cnost, proto se \u017e\u00e1dn\u00e1 t\u0159et\u00ed osoba nem\u016f\u017ee dom\u00e1hat ochrany s odkazem na dobrou v\u00edru v z\u00e1pis v katastru nemovitost\u00ed (tzv. z\u00e1sadu materi\u00e1ln\u00ed publicity).<\/p>\n<p>V p\u0159\u00edpad\u011b dispozice s nemovitost\u00ed ze strany \u017eenat\u00fdch fyzick\u00fdch osob by tak m\u011bla druh\u00e1 strana v\u017edy vy\u017eadovat i prohl\u00e1\u0161en\u00ed druh\u00e9ho z man\u017eel\u016f, \u017ee se v dot\u010den\u00e9 nemovitosti nenach\u00e1z\u00ed rodinn\u00e1 dom\u00e1cnost, resp. \u017ee dot\u010den\u00fd man\u017eel s p\u0159edm\u011btn\u00fdm pr\u00e1vn\u00edm jedn\u00e1n\u00edm ve vztahu k nemovitosti (nap\u0159. prodej \u010di zastaven\u00ed) souhlas\u00ed.
