Co pro to mus\u00ed ud\u011blat?  <\/strong><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Co se rozum\u00ed \u0161ikanou na pracovi\u0161ti<\/strong><\/h2>\n\n<p class=\"has-background wp-block-paragraph\" style=\"background-color:#f5fef0\">Pojem \u0161ikana na pracovi\u0161ti \u2013 ve form\u011b <strong>mobbingu, bossingu<\/strong> \u010di jin\u00fdch forem \u2013 nen\u00ed v \u010desk\u00e9m pr\u00e1vn\u00edm \u0159\u00e1du v\u00fdslovn\u011b definov\u00e1n, p\u0159esto na n\u011bj n\u011bkter\u00e1 z\u00e1konn\u00e1 ustanoven\u00ed pamatuj\u00ed. Ozna\u010dujeme j\u00ed zejm\u00e9na jako zjevn\u00e9 zneu\u017eit\u00ed pr\u00e1va dle \u00a7 8 ob\u010dansk\u00e9ho z\u00e1kon\u00edku a jako poru\u0161en\u00ed z\u00e1kladn\u00edch pracovn\u011bpr\u00e1vn\u00edch z\u00e1sad, v\u010detn\u011b ochrany postaven\u00ed zam\u011bstnance, pr\u00e1va na bezpe\u010dn\u00e9 pracovn\u00ed podm\u00ednky a z\u00e1sady rovn\u00e9ho zach\u00e1zen\u00ed. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Kdo odpov\u00edd\u00e1 za \u0161ikanu na pracovi\u0161ti?<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Zam\u011bstnavatel nese objektivn\u00ed odpov\u011bdnost za \u00fajmu vzniklou zam\u011bstnanci<\/strong> p\u0159i pln\u011bn\u00ed pracovn\u00edch \u00fakol\u016f \u2013 \u0161ikanu nevyj\u00edmaje \u2013 a\u0165 ji zp\u016fsobil vedouc\u00ed, nebo \u0159adov\u00fd zam\u011bstnanec. <strong>Po\u0161kozen\u00fd proto uplat\u0148uje n\u00e1roky prim\u00e1rn\u011b v\u016f\u010di zam\u011bstnavateli.<\/strong> P\u0159edpokladem odpov\u011bdnosti je vznik majetkov\u00e9 \u0161kody \u010di nemajetkov\u00e9 \u00fajmy v d\u016fsledku \u0161ikany (nap\u0159. \u00fajma na zdrav\u00ed, v\u010detn\u011b psychick\u00e9), poru\u0161en\u00ed pr\u00e1vn\u00ed povinnosti \u010di dobr\u00fdch mrav\u016f a p\u0159\u00ed\u010dinn\u00e1 souvislost.<\/p>\n\n<p class=\"wp-block-paragraph\">V praxi tak m\u016f\u017ee j\u00edt o:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>n\u00e1hradu<\/strong> <strong>l\u00e9\u010debn\u00fdch n\u00e1klad\u016f<\/strong>,<\/li>\n\n\n\n<li><strong><strong>n\u00e1hradu u\u0161l\u00e9ho v\u00fdd\u011blku,<\/strong><\/strong><\/li>\n\n\n\n<li><strong>od\u010din\u011bn\u00ed z\u00e1sahu do d\u016fstojnosti a jin\u00fdch p\u0159irozen\u00fdch pr\u00e1v. <\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Judikatura dovodila, \u017ee i nap\u0159. <strong>posttraumatick\u00e1 stresov\u00e1 porucha<\/strong> vznikl\u00e1 z jednor\u00e1zov\u00e9ho \u0161ikan\u00f3zn\u00edho intenzivn\u00edho incidentu na pracovi\u0161ti m\u016f\u017ee b\u00fdt kvalifikov\u00e1na <strong>jako pracovn\u00ed \u00faraz<\/strong>, z \u010deho\u017e n\u00e1sledn\u011b plyne zvl\u00e1\u0161tn\u00ed re\u017eim od\u0161kod\u0148ov\u00e1n\u00ed dle z\u00e1kon\u00edku pr\u00e1ce. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Odpov\u00edd\u00e1 i s\u00e1m \u0161ikanuj\u00edc\u00ed?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Odpov\u011bdnosti se v\u0161ak zcela nezbavuje ani \u0161ikanuj\u00edc\u00ed zam\u011bstnanec, nebo\u0165 zam\u011bstnavatel proti n\u011bmu m\u016f\u017ee uplatnit <strong>regresn\u00ed n\u00e1rok.<\/strong> Jeho v\u00fd\u0161e z\u00e1vis\u00ed na m\u00ed\u0159e zavin\u011bn\u00ed takov\u00e9ho zam\u011bstnance na jedn\u00e9 stran\u011b a na m\u00ed\u0159e zavin\u011bn\u00ed zam\u011bstnavatele na stran\u011b druh\u00e9.  <strong>Odpov\u011bdnosti se v\u0161ak zcela nezbavuje ani \u0161ikanuj\u00edc\u00ed zam\u011bstnanec, nebo\u0165 zam\u011bstnavatel proti n\u011bmu m\u016f\u017ee uplatnit regresn\u00ed n\u00e1rok. Jeho v\u00fd\u0161e z\u00e1vis\u00ed na m\u00ed\u0159e zavin\u011bn\u00ed takov\u00e9ho zam\u011bstnance na jedn\u00e9 stran\u011b a na m\u00ed\u0159e zavin\u011bn\u00ed zam\u011bstnavatele na stran\u011b druh\u00e9.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Co z toho plyne pro zam\u011bstnavatele?<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Pro zam\u011bstnavatele z toho plynou konkr\u00e9tn\u00ed pou\u010den\u00ed: deklarativn\u00ed \u201enulov\u00e1 tolerance\u201c zakotven\u00e1 v intern\u00edch p\u0159edpisech nesta\u010d\u00ed. Je nutn\u00e9<strong> \u0161ikanu aktivn\u011b vyhled\u00e1vat<\/strong>, ka\u017ed\u00e9 ozn\u00e1men\u00ed na podez\u0159en\u00ed bez pr\u016ftah\u016f pro\u0161et\u0159it a p\u0159ijmout \u00fa\u010dinn\u00e1 opat\u0159en\u00ed nejen k n\u00e1prav\u011b, n\u00fdbr\u017e tak\u00e9 k p\u0159edch\u00e1zen\u00ed.
