Nejvy\u0161\u0161\u00ed soud nyn\u00ed up\u0159esnil, kdy to mo\u017en\u00e9 je \u2013 a kdy ne.<\/h6>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Jak se ur\u010duje n\u00e1hrada p\u0159i vypo\u0159\u00e1d\u00e1n\u00ed spoluvlastnictv\u00ed<\/strong><\/h2>\n\n\n\n<p>Ka\u017ed\u00fd spoluvlastn\u00edk m\u00e1 pr\u00e1vo po\u017eadovat zru\u0161en\u00ed a vypo\u0159\u00e1d\u00e1n\u00ed spoluvlastnictv\u00ed nebo sv\u00e9 odd\u011blen\u00ed z n\u011bj.<\/p>\n\n\n\n<p>Pokud soud rozhodne o p\u0159ik\u00e1z\u00e1n\u00ed spoluvlastnick\u00e9ho pod\u00edlu jin\u00e9mu spoluvlastn\u00edkovi, vznik\u00e1 p\u016fvodn\u00edmu spoluvlastn\u00edkovi n\u00e1rok na p\u0159im\u011b\u0159enou n\u00e1hradu, za kterou se pova\u017euje hodnotov\u00fd ekvivalent vyj\u00e1d\u0159en\u00fd v&nbsp;pen\u011bz\u00edch, umo\u017e\u0148uj\u00edc\u00ed podle m\u00edstn\u00edch podm\u00ednek obstar\u00e1n\u00ed obdobn\u00e9 v\u011bci. N\u00e1hrada je obvykle stanovena podle velikosti pod\u00edlu na obvykl\u00e9 cen\u011b spole\u010dn\u00e9 v\u011bci.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-6d6aeadaf894d64b2293f2943c235ad2\" style=\"color:#289b41\"><strong>M\u016f\u017ee soud n\u00e1hradu sn\u00ed\u017eit?<\/strong><\/h3>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed soud se zab\u00fdval ot\u00e1zkou, zda je mo\u017en\u00e9 v\u00fd\u0161i t\u00e9to n\u00e1hrady ur\u010dit jinak v p\u0159\u00edpad\u011b, \u017ee zru\u0161en\u00ed spoluvlastnictv\u00ed iniciuje osoba, jej\u00ed\u017e podnik\u00e1n\u00ed spo\u010d\u00edv\u00e1 ve v\u00fdkupu pod\u00edl\u016f (nejen) v nucen\u00fdch dra\u017eb\u00e1ch a jejich n\u00e1sledn\u00e9m zpen\u011b\u017eov\u00e1n\u00ed prost\u0159ednictv\u00edm soudn\u00edho vypo\u0159\u00e1d\u00e1n\u00ed. Vzhledem k&nbsp;tomu, \u017ee p\u0159ik\u00e1z\u00e1n\u00ed spoluvlastnick\u00e9ho pod\u00edlu p\u0159edstavuje nucen\u00e9 odejmut\u00ed vlastnick\u00e9ho pr\u00e1va, soud p\u0159i sv\u00fdch \u00favah\u00e1ch zohlednil \u00fastavn\u00ed po\u017eadavky stanoven\u00e9 \u010dl\u00e1nkem 11 odst. 4 Listiny, co\u017e je mimo jin\u00e9 poskytnut\u00ed p\u0159im\u011b\u0159en\u00e9 n\u00e1hrady.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Nejvy\u0161\u0161\u00ed soud potvrdil, \u017ee:<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>v\u00fd\u0161e n\u00e1hrady podl\u00e9h\u00e1 korektivu dobr\u00fdch mrav\u016f; a<\/li>\n\n\n\n<li>soud m\u016f\u017ee v\u00fdjime\u010dn\u011b s&nbsp;odkazem na korektiv dobr\u00fdch mrav\u016f modifikovat vypo\u0159\u00e1dac\u00ed pod\u00edly b\u00fdval\u00fdch spoluvlastn\u00edk\u016f, pop\u0159\u00edpad\u011b n\u00e1hradu zcela nep\u0159iznat.<\/li>\n<\/ul>\n\n\n\n<p>Takov\u00fd postup v\u0161ak p\u0159ipad\u00e1 v \u00favahu pouze ve zcela v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech z\u00e1sadn\u00edho rozporu jedn\u00e1n\u00ed \u00fa\u010dastn\u00edk\u016f \u0159\u00edzen\u00ed s dobr\u00fdmi mravy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-8c56bfb0c6936b2f619be2ecdd50713a\" style=\"color:#289b41\"><strong>Co soud nepova\u017euje za d\u016fvod ke sn\u00ed\u017een\u00ed?<\/strong><\/h3>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed soud s&nbsp;odkazem na svou d\u0159\u00edv\u011bj\u0161\u00ed judikaturu a judikaturu \u00dastavn\u00edho soudu uvedl, \u017ee za takov\u00e9 mimo\u0159\u00e1dn\u00e9 okolnosti ospravedl\u0148uj\u00edc\u00ed pou\u017eit\u00ed korektivu dobr\u00fdch mrav\u016f za \u00fa\u010delem sn\u00ed\u017een\u00ed vypo\u0159\u00e1dac\u00edho pod\u00edlu nelze bez dal\u0161\u00edho pova\u017eovat:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>v\u00fdhodn\u00e9 nabyt\u00ed spoluvlastnick\u00e9ho pod\u00edlu ve ve\u0159ejn\u00e9 dra\u017eb\u011b, ani<\/li>\n\n\n\n<li>vyv\u00edjen\u00ed takov\u00e9 podnikatelsk\u00e9 aktivity <\/li>\n<\/ul>\n\n\n\n<p>Samotn\u00fdm smyslem investov\u00e1n\u00ed do nemovitost\u00ed je dle Nejvy\u0161\u0161\u00edho soudu toti\u017e pr\u00e1v\u011b o\u010dek\u00e1van\u00fd ekonomick\u00fd prosp\u011bch, a&nbsp;nem\u011bl-li by z&nbsp;investice vlastn\u00edkovi plynout, postr\u00e1dala by logicky takov\u00e1 investice smysl. Uveden\u00e9 okolnosti tak dle Nejvy\u0161\u0161\u00edho soudu nemohou b\u00fdt samy o sob\u011b pova\u017eov\u00e1ny za <em>a priori<\/em> nemravn\u00e9 a bez dal\u0161\u00edho nejsou tedy d\u016fvodem pro sn\u00ed\u017een\u00ed v\u00fd\u0161e p\u0159im\u011b\u0159en\u00e9 n\u00e1hrady p\u0159i vypo\u0159\u00e1d\u00e1n\u00ed spoluvlastnictv\u00ed.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-regular\"><table class=\"has-background has-border-color has-fixed-layout\" style=\"background-color:#f5fef0;border-color:#f5fef0;border-width:20px\"><tbody><tr><td><strong>Z\u00e1v\u011br pro praxi<\/strong><br><strong><br><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">V\u00fd\u0161e n\u00e1hrady p\u0159i vypo\u0159\u00e1d\u00e1n\u00ed spoluvlastnictv\u00ed z\u016fst\u00e1v\u00e1 standardn\u011b nav\u00e1z\u00e1na na obvyklou cenu spole\u010dn\u00e9 v\u011bci a v\u00fd\u0161i spoluvlastnick\u00e9ho pod\u00edlu.
