Rozhoduj\u00edc\u00ed je, zda pracovn\u00ed m\u00edsto skute\u010dn\u011b zaniklo \u2013 a pr\u00e1v\u011b to Nejvy\u0161\u0161\u00ed soud v ned\u00e1vn\u00e9m rozhodnut\u00ed up\u0159esnil.<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Jak poznat, \u017ee pracovn\u00ed m\u00edsto bylo skute\u010dn\u011b zru\u0161eno<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed soud ve sv\u00e9m rozhodnut\u00ed (sp. zn. 21 Cdo 3286\/2024) \u0159e\u0161il, za jak\u00fdch okolnost\u00ed lze pracovn\u00ed pozici pova\u017eovat za skute\u010dn\u011b zru\u0161enou.<\/p>\n\n\n\n<p>Rozhoduj\u00edc\u00ed nen\u00ed form\u00e1ln\u00ed ozna\u010den\u00ed zm\u011bny, ale faktick\u00fd stav. Kl\u00ed\u010dov\u00e9 je, jakou pr\u00e1ci zam\u011bstnanec vykon\u00e1v\u00e1.<\/p>\n\n\n\n<p>Pokud nov\u00fd zam\u011bstnanec nastoup\u00ed na d\u0159\u00edve \u201ezru\u0161enou\u201c pozici a vykon\u00e1v\u00e1 stejnou pr\u00e1ci, by\u0165 p\u0159i jin\u00e9m rozsahu pracovn\u00ed doby, nelze uzav\u0159\u00edt, \u017ee pracovn\u00ed m\u00edsto zaniklo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kdy n\u00e1rok na odstupn\u00e9 nevznik\u00e1<br><\/h2>\n\n\n\n<p>N\u00e1rok na odstupn\u00e9 nevznik\u00e1 v situaci, kdy pracovn\u00ed pozice fakticky nezanikla.<\/p>\n\n\n\n<p>To nast\u00e1v\u00e1 zejm\u00e9na tehdy, pokud:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pracovn\u00ed m\u00edsto nad\u00e1le existuje v organiza\u010dn\u00ed struktu\u0159e<\/li>\n\n\n\n<li>je obsazeno jinou osobou, anebo<\/li>\n\n\n\n<li>do\u0161lo pouze ke zm\u011bn\u011b podm\u00ednek (nap\u0159. rozsahu \u00favazku)<\/li>\n<\/ul>\n\n\n\n<p>V takov\u00e9m p\u0159\u00edpad\u011b nen\u00ed spln\u011bna podm\u00ednka existence skute\u010dn\u00e9 organiza\u010dn\u00ed zm\u011bny.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ani dlouhodob\u00e1 neobsazenost neznamen\u00e1 zru\u0161en\u00ed pozice<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>Soud se zab\u00fdval i situac\u00ed, kdy pracovn\u00ed m\u00edsto z\u016fst\u00e1v\u00e1 del\u0161\u00ed dobu neobsazen\u00e9.<\/p>\n\n\n\n<p>Ani tato skute\u010dnost sama o sob\u011b neznamen\u00e1, \u017ee bylo m\u00edsto zru\u0161eno.
